On January 6 Sears came to my house to replace the Kenmore refrigerator's computer. The Sears employee stepped on the water line ripping it out of the basement waster pipe. It was a mess. I ran to the basement to shut off the house water supply and clean up the mess.
The technician went to the basement to restore the water line. He asked for a flashlight since he did not have one. I brought it, and then he asked to hold the light so he could see. Then he asked for a pair of pliers which I brought him. Then he asked for a step ladder. I told him no, mine was in a tool shed and there was 4 feet of snow around it.
He then asked for a heavy chair. I brought it down the steps to the basement but at the next to the last step my knee went out. I found myself screaming and rolling on the ground. My knee was no longer rounded but formed a giant V shape.
I was taken to the ER. Several weeks later I found out I had torn my quadriceps muscle and tendon. It leads to surgery and 9 months of physical therapy.
I lost over several months wages, was house bound over 3 months, I could not drive for 4 months, pain and suffering, lost consort with my wife for 5 months. I am out many tens of thousands of dollars.
Sedgwick, the insurance company for Sears, has told me that there is no liability for Sears since it took place in my house. That may be legally correct but it seems immoral or wrong to be able to cause such an injury and bear no responsibility for creating the situation.
My right leg is weak and wobbly. My knee gives out and I fall without warning. I have trouble walking down stairs and my injury seems to be permanent. I have purchased Sear's products all of my life but now I am reevaluating that since I have been treated so badly.
